Copyright Assumption Policy, Notification and Procedure

It is our policy to respond promptly to proper notices of alleged copyright infringement that comply with the Copyright Act (DMCA), (the text of which can be found on the U.S. Copyright Office website, http://www.copyright.gov).

All users of any portion of happynewsfeed.com are expected to comply with applicable copyright laws. However, if we receive proper notice of alleged copyright infringement, our response to such notices will include removing or disabling access to the allegedly infringing material and/or terminating contributors, regardless of whether we may be liable for such infringement under the laws of the United States or the laws of any other jurisdiction.

If we remove or disable access in response to such a notification, we will make a good faith attempt to contact the creator of the content in question so that he or she may file a counter-notification under Section 512(g)(2) and (3) of the DMCA. We may also document notices of alleged infringement upon which we will act.

NOTICE OF COPYRIGHT INFRINGEMENT: Filing a DMCA Notice of Copyright Infringement

Upon receipt of proper notice of alleged copyright infringement, happynewsfeed.com will follow the procedures set forth in this document and the DMCA.

In order to file a notice of copyright infringement with happynewsfeed.com, you must provide a written communication (via email, fax, and mail) that includes the information listed below.

Please note that if the material infringes your copyright, you will be liable for damages (including costs and attorney’s fees). Therefore, if you are unsure whether you are the proper copyright holder or whether copyright laws protect your material, you may wish to consult an attorney.

To expedite our ability to process your request, please use the following format (including section numbers):

Your contact information, including your name, address, phone number, and, if possible, an email address where we can contact you as the complainant;
A statement: ‘I am the copyright owner or an agent authorised to act on behalf of the owner of the following copyrighted material:’;
Identify in sufficient detail the copyrighted content that you believe has been infringed. (For example, “The copyrighted image in question is “Title of Content” which can be described as “Description: Literary Work, Image, etc.” “author’s name,” including federal registration information, if available);
Identification of the material claimed to be infringing or to be the subject of infringing activity that is to be removed or to be made inaccessible, and information reasonably sufficient to enable happynewsfeed.com to locate the material (e.g., “Article Title” at this location: https://happynewsfeed.com/link-to-article/);
The following statement: “I believe in good faith that the use of the above material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
The following statement, “I swear under penalty of perjury that the information in the notice is accurate”; and
Sign the document.

Counter-notification

A content provider that is alleged to be infringing may file a counter-notice under Section 512(g)(2) and (3) of the Digital Millennium Copyright Act.

To file a counter-notification with us, you must provide us with a written notice (by regular mail) that includes the information listed below. By prior written agreement, you may not disclose the information listed below by email. Please note that you will be liable for damages (including costs and attorney’s fees) if you materially misrepresent that a product or activity does not infringe the copyrights of others. Therefore, if you are unsure whether certain material infringes the copyrights of others, we recommend that you first contact an attorney.

To expedite the processing of your request, please use the following format (including section numbers):

The material that has been removed or access to which has been disabled, and the location where the material appeared before it was removed or access to it was disabled;
Your name, address, telephone number and, if available, an email address at which you can be contacted;
The following statement: “I consent to the jurisdiction of the federal district court for the [insert federal judicial district in which your address is located].”
The following statement: “I accept service of process from [insert name of person filing notice of violation] or his or her attorney.”
The following statement, “I swear under penalty of perjury that I have a good faith belief that the material in question has been removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled”; and
Sign the document.

Upon receipt of such counter-notice, happynewsfeed.com will promptly provide the person who provided the original infringement notice with a copy of the counter-notice and inform them that happynewsfeed.com will replace the removed material or cease disabling access to it within 10 business days happynewsfeed.com will replace the removed material and cease disabling access to it no sooner than 10 and no later than 14 business days after receipt of the counter-notification, unless our authorized representative first receives notice from the person who provided the original notice of infringement that such person has filed an action for an injunction prohibiting the subscriber from engaging in infringing activity involving material on our system or network.

Repeated infringements

In accordance with Section 512(i)(1)(A) of the DMCA, happynewsfeed.com will, in appropriate circumstances, disable and/or terminate the accounts of contributors who are repeat infringers.
